The OCDA has published a letter containing the investigation findings and legal conclusions regarding the Anaheim Police Department’s officer-involved-shooting of Gerardo Pineda.
The OCDA cleared Anaheim Police Investigator Kelly Phillips, who shot Pineda, of any wrongdoing. The OCDA’s investigation identified Pineda as a known gang member nicknamed “Ghost.”
He tested positive for meth and amphetamines after the shooting. At the time he was suspected of stealing a car and paricipating in a drive by shooting in Riverside.
Pineda survived the shooting and he was ultimately sentenced to jail for two years on several counts including Criminal Street Gang Activity.
